Privacy Policy


The policy described herein (the “Privacy Policy”) describes how RTPCAP treats information that it collects and receives through its websites, products, services, and content thereon (collectively, the “RTPCAP Site”). IF THE PRIVACY POLICY IS NOT ACCEPTED BY YOU IN FULL, OR IF YOU ARE UNWILLING OR UNABLE TO BE BOUND BY THE PRIVACY POLICY, YOU MUST IMMEDIATELY CEASE ALL ACCESS AND USE OF THE RTPCAP SITE.


This Privacy Policy is effective as of August 23, 2020.


1. Definitions.


a. “Content” – Any and all text, images, photos, audio, video, and all other forms of data or communication contained on or generated by use of the RTPCAP Site.


b. “Personal Information” – Any and all information about a User that makes the User personally identifiable, including name, address, email address, and phone number.


c. “RTPCAP” – RTPCAP shall refer to RTP Capital Advisors, LLC, a limited liability company organized under the laws of Florida, as well as to its current or future parents, subsidiaries, affiliates, suppliers, licensors, partners, and the officers, directors, members, employees, agents, and representatives of each.


d. “Third-Party” – Collectively refers to all parties other than RTPCAP and its Users.


e. “Third-Party Content” – Content made available on the RTPCAP Site by a Third Party, including but not necessarily limited to data submitted by advertisers.


f. “User” – Anyone who accesses, browses or in any way uses the RTPCAP Site, including but not limited to Users with valid User Profiles. As used in the Privacy Policy, the terms “you” and “your” refer to you and/or the business entity or organization that you represent as a User of the RTPCAP Site.


g. “User Profile” – Profile, account, and/or registration created by or for a User for the purpose of accessing and/or using certain features of the RTPCAP Site.


2. General.


a. By accessing and using the RTPCAP Site, you acknowledge that you have read and understand the Privacy Policy and that you accept and agree to be bound by the terms and conditions of the Privacy Policy.


b. The Privacy Policy may be updated, changed and added to by RTPCAP from time to time, and RTPCAP will use commercially reasonable efforts to provide you with notice of such updates, changes and additions. You can review the most current version of the Privacy Policy by revisiting this page. You should revisit the Privacy Policy on a regular basis as revised versions are binding on you. RTPCAP may provide you with notices, including those regarding updates, changes and additions to the Privacy Policy, by email, regular mail, or postings on the RTPCAP Site.


c. You understand and agree that your continued access to or use of the RTPCAP Site after any update, modification or addition to the Privacy Policy indicates your acceptance of the update, modification or addition.


d. This Privacy Policy does not apply to the practices of Third-Parties, including the owners of advertisements on the RTPCAP Site or to parties other than Users of the RTPCAP Site. If you select a link to be taken to the website of a Third-Party, RTPCAP encourages you to review the separate privacy policies and terms of use/service for each site that you visit.


e. RTPCAP is not responsible for Third-Party acts or omissions, including the practices of any Third-Party websites or the nature of Third-Party Content, including advertisements that may be placed on the RTPCAP Site.


3. Policy regarding use of the RTPCAP Site by minors/children.


a. The RTPCAP Site is not directed to people under the age of 18, and RTPCAP does not knowingly collect any information from people under the age of 18. Minors may not create a User Profile.


b. If you become aware that your child has provided RTPCAP with information (1) without your consent or (2) contrary to the provisions of this Privacy Policy, please contact RTPCAP to work towards removing this information.


4. Translations.


a. RTPCAP may translate the Privacy Policy into languages other than English for your convenience. However, the English version governs your relationship with RTPCAP and any inconsistencies in the translations will be resolved in favor of the English version.


5. User Profiles.


a. In order to access and/or use certain features of the RTPCAP Site, you must create a valid User Profile. Information that RTPCAP may collect when you create or update a User Profile includes, but is not limited to:


i. First and last name and/or organization name


ii. Physical address


iii. Email address


iv. Phone number, including area code


v. Certain additional information that RTPCAP may find relevant.


b. Once you have created a valid User Profile, you will be able to access and/or use certain features of the RTPCAP Site.


c. User Profiles may have a unique username and a password to use in accessing such User Profiles.


d. Even after you remove information from your User Profile or delete your User Profile, copies of your information may remain in the possession of RTPCAP.


6. Information received by RTPCAP and how RTPCAP uses that information.


a. RTPCAP may use information that you provide for routine administrative purposes, including but not limited to investigating abuses on the RTPCAP Site, responding to inquiries, and enforcing and applying the Terms of Service. RTPCAP may also incorporate information you provide in its customer relationship management (CRM) system, and add to your profile any other information RTPCAP collects about you from third party sources, including publicly available information. RTPCAP may use such information in order to contact you regarding RTPCAP's products and services.


b. RTPCAP may keep track of some of the actions you take on the RTPCAP Site, such as adding or revising profile information.


c. When you access the RTPCAP Site from a computer, mobile phone, or other device, RTPCAP may collect information from that device about your browser type, location, and IP address, as well as the pages you visit.


d. RTPCAP may share aggregated information with Third-Parties to help improve or promote the RTPCAP Site. No Personal Information is revealed in this aggregated information.


e. RTPCAP may disclose information about you, including Personal Information, in response to requests from law enforcement officials in connection with their official duties (for example, criminal investigations, subpoenas, court orders, etc.) or if RTPCAP is otherwise required to disclose such information by law. RTPCAP also will release information where disclosure is necessary to protect its legal rights, to enforce the Terms of Service or other agreements, or to protect RTPCAP or others from fraud.


f. Administrators of the RTPCAP Site and/or companies hired by RTPCAP to perform technical/customer support may have access to information stored by RTPCAP, including but not limited to Personal Information. RTPCAP will make reasonable efforts to protect the confidentiality of Personal Information, including access, use, or disclosure by such individuals or companies.


g. RTPCAP may disclose information about you, including Personal Information, to Third-Parties that provide services to RTPCAP (e.g., for payment process, marketing communications, email delivery, and other business operations).


h. In the event RTPCAP is acquired by, or merge or consolidate into, another entity, or if there is a sale of RTPCAP's assets (including in bankruptcy), your information may be transferred to the entity acquiring RTPCAP or its assets or that survives the merger or consolidation. You acknowledge and agree that in the foregoing circumstances, your information may be disclosed to such Third-Party.


i. RTPCAP reserves the right to send certain communications relating to RTPCAP, its products or services, or the RTPCAP Site to the email address associated with your User Profile. You may opt out of all communications except updates essential to your User Profile. RTPCAP may include Content you see on the RTPCAP Site in emails that it sends to you.


7. Cookies, web beacons and clear GIFs.


a. Like many sites, the RTPCAP Site may employ cookies and web beacons (also known as clear GIF technology or “action tags”) to speed your navigation of the RTPCAP Site, recognize Users, and track your usage of the RTPCAP Site. Cookies are small pieces of alphanumeric information that are stored as text files by your Internet browser on your computer’s hard drive. Web beacons assist in delivering cookies and help RTPCAP determine whether a web page on the RTPCAP Site has been viewed and, if so, how many times.


b. Through the use of cookies, RTPCAP may collect certain information about your equipment, browsing actions and patterns, including details of your visits to the RTPCAP Site, including traffic data, location data, and other communication data, and the resources that you access and use on the RTPCAP Site. We may also collect data about your computer and internet connection, including your IP address, operating system and browser type. We may use this information to estimate our audience size and usage patterns, store information about your preferences, speed up your searches, and recognize you when you return to the RTPCAP Site.


c. Cookies controlled by RTPCAP are not “spyware” and cannot infiltrate a User’s hard drive to access a User’s confidential information.


d. Most Internet browsers are initially set to accept cookies. You can set your browser to refuse cookies from websites or to remove cookies from your hard drive, but if you do, you may not be able to access or use certain portions of the RTPCAP Site.


e. During some visits, RTPCAP may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.


f. In addition to our own cookies, we may engage third party vendors to use their cookies to report to us usage statistics of the RTPCAP Site, deliver advertisements on and through the RTPCAP Site, and for other similar purposes.


8. Information storage and security.


a. RTPCAP has commercially reasonable physical, electronic, and procedural safeguards to protect Users’ information.


b. RTPCAP may use automated and social measures to enhance security, such as analyzing account behavior for fraudulent or otherwise anomalous behavior.


c. No method of transmission over the Internet, or method of electronic storage, is 100% secure. As a result, while RTPCAP strives to use reasonable methods to protect your information, it cannot provide a guarantee with regard to its absolute security. RTPCAP cannot control the actions of other Users with whom you share your information. RTPCAP cannot guarantee that only authorized persons will view your information. RTPCAP cannot ensure that information you share on the RTPCAP Site will not become publicly available. RTPCAP is not responsible for third-party circumvention of any privacy settings or security measures on the RTPCAP Site. You can reduce these risks by using common sense security practices such as choosing a strong password, using different passwords for different services, and using up to date antivirus software.


d. You should report any security violations to RTPCAP.


9. California Do Not Track Disclosure.


At this time, we do not respond to browser 'Do Not Track' signals.


10. International Users


The RTPCAP Site is intended for individuals located in the United States. If you are located outside of the United States and access the RTPCAP Site or submit your information to RTPCAP, you do so at your own risk and choice. United States law may not offer the same privacy protections as the law of your jurisdiction. If you visit the RTPCAP Site, or contact RTPCAP, from outside of the United States, please be advised that (a) any information you provide or that RTPCAP automatically collects will be transferred to the United States; and (b) that by using the RTPCAP Site or submitting information, you explicitly authorize its transfer to and subsequent processing in the United States in accordance with this Privacy Policy and United States law.


11. Miscellaneous


a. If any provision, or portion thereof, of the Privacy Policy is unenforceable, prohibited, or invalid under, or contrary to, any applicable statute or rule of law, it will be modified to the least extent necessary to make it enforceable, such enforceability shall not affect any other provision of the Privacy Policy, and the remaining Privacy Policy will remain in full force and effect. Further, such invalidity, prohibition, or unenforceability in such jurisdiction shall not invalidate or render unenforceable such provision in any other jurisdiction.


b. This Privacy Policy is subject to and incorporated by reference into the Terms of Service which govern the RTPCAP Site, including the provisions governing any disputes hereunder, and related issues of jurisdiction, venue and choice of law.
